In U.S. usually the eldest member of the family is responsible for the property inherited by the father. The elder law in U.S. includes three main aspects such as estate management, disability factor, and guardianship. The elder law also covers many other aspects such as abuse or fraud, if committed by the elder, trusts, medical care, social security benefits or any other benefits that are available.
The elder law attorney are also greatly in demand today in U.S. because every family requires advice and consultation about elder law applicable. The elder law attorneys are usually specialized in family laws. They choose family law as their specialized subject when they are studying law degree. They can also choose civil law alternatively if the institute does not offer them family law as a major subject. During their law course, they can study various aspects about family law such as possession of the property, rights and duties of the elders, terms and conditions if the elder person is disabled and the overall duties and responsibilities as an elder to the family.
He should preferably enroll his name in a reputed law institute that is recognized by the American Bar Association for bachelors and master’s degree. He can join bachelor’s’ degree in law after completing his graduation or second year of his college. After completing his degree he can apply for internship in a law firm or court. He can also apply for court clerkship to gain practical experience about his subject.
He can become a professional elder law attorney by independently handling the cases later on. He can work as an independent attorneys and the attorneys usually most of the attorneys specializing in elder law work independently. They can also serve in the court after gaining some years of experience.
The elder law attorney who have specialized in elder law can seek jobs in various positions such as legal assistants, lawyers, paralegals, secretaries etc. They can be also play a role as financial planner, policy makers, advocates etc. Many government bodies such as Better Business Bureau, Consumer Protection Agency, and Attorney’s General Office require them. Many professionals who have studied elder law work in various agencies for position such as health care provider, funeral planners, abuse and fraud investigators, transportation providers etc.
The elder law attorney work as both advisors and advocates. Alternatively, after completing graduation in any field they can seek for an advanced degree or a certification degree in elder law. If the candidate should gain admissions in reputed colleges, they should usually pass the Law School Admission Test and hence they can gain admission in a reputed institute that is accredited by American Bar Association. After attaining the Juris degree, the candidate should get approval from state bar association.
They should obtain certification from the Board of Certification of the National Elder Law Foundation if they wish to specialize in the subject. Before applying for a certification, they should work for either 5 years or 3 years for a legal firm or any other agency. They should obtain certification from at least 5 reputed lawyers by passing a written test.
